Yes, the amount can still be recovered, provided you take the correct legal steps immediately. Since you have bank transfer proof and bounced cheques, these are strong evidences showing a legally enforceable debt. Even though the cheques bounced in 2022, you can still recover the amount through: 1️⃣ Civil Money Recovery Suit under Order 37 CPC / Summary Suit or regular money suit. ➤ Limitation period is 3 years from the date of last acknowledgment or last transaction. ➤ If there is any message, written promise, or part-payment after 2022, limitation extends further. 2️⃣ If the borrower threatened you, you may also file a Police Complaint for criminal intimidation and cheating under Sections 406, 420, 506 IPC. 3️⃣ Cheque bounce criminal case under Section 138 NI Act is time-bound, but civil recovery is still fully maintainable based on documentary evidence. Your case is legally strong because: There is proof of payment (20 Lakhs) There are bounced cheques, which prove liability Refusal to repay + threats strengthen the case You can recover the entire amount with interest through court.
