Hi,
My mother has filed a money suite against an individual in 2022 and won the case in 2024. Now the lawyer who took up the case is reluctant to proceed with Executive proceedings against the defendant stating, the EP proceedings should done from her place which 50 km away from our place. So I need help in this regard.
Execution petition proceedings must be filled in the same court that passed the judgement . Is there the defendants assets are located in the same place or in different place ❓. If the defendant's assets are 50 km away, you must clarify whether the executive petition must be filed in your mother's Court or the defendant's local Court . immediately Consult a lawyer to file an executive petition in the original Court.

hi if the lawyer is unwilling to file the execution petition afresh then you could file it through new advocate depending on the place of propertys location and the estimation value of the cost involved in it
