Loan Recovery from Friend given over the period of 6 months l

Hello Team Since December 2024 I helped the girl with RS 20k and now as 6 months have passed she has taken about 10 Lakhs. All payment done via Google pay and some via Credit Card of mine. On asking for return she says there is some property in Punjab which they will sell but till date no reply of return. I have proof of payment given. Even her residence address is incorrect. What action I can Take for recovery please advice Thanks and Regards

First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime file a recovery suit in the court to claim your money back along with compensations.

In order to get your money back which itself is a huge amount, the only legal remedy available to you is filing a recovery of money case in the court having appropriate jurisdiction. Kindly keep in mind that money recovery suits have limitation period, and you can only file the case before the expiration of the limitation.

You can issue a legal notice demanding repayment along with interest. If there's no response, file a civil suit for recovery under Order 37 CPC based on documentary evidence of payments made. You may also file a police complaint for cheating and criminal breach of trust under Sections 420 and 406 IPC, especially since the address given appears fake. Preserve all proofs like transaction records, messages, and call logs. Legal recovery is possible, but immediate steps are needed to trace her and initiate proceedings.

Hi - so this is a clear cut option in such cases to file a recovery suit against the person concerned and notice will be issued to them.
