Lent money not able to recover

It has been 12 years since my mother lent ₹30,000 to our neighbour to help with a medical emergency. We did not have a promissory note or any written agreement at the time. However, I have phone call recordings in which they acknowledge the loan. They have repaid only ₹15,000 so far, leaving an outstanding balance of ₹15,000. They are now avoiding our calls, and whenever they do respond, their attitude is irresponsible and they are unwilling to repay

You may send a legal notice and preserve the call recordings and proof of part payment. However, as the loan is 12 years old, any recovery suit is likely to face a limitation objection. A final opinion depends on the dates and available evidence.

On the facts stated, a civil recovery claim may still be maintainable if the borrower's subsequent acknowledgments or part-payment legally extend the limitation period. Your call recordings acknowledging the debt and proof of repayment of ₹15,000 may constitute important evidence. Immediately issue a detailed legal notice demanding payment of the outstanding amount and preserve all documentary and electronic evidence. If the borrower fails to comply, consult an advocate to examine limitation and institute appropriate civil recovery proceedings without further delay.
