Hi there, at first Muslim Law is not going to affect you at all. In order to file a case against him in India you need to hire a lawyer here and provide proof of payments, post that you have to sign a special power of attorney with the lawyer. In order to file a case against him you primarily need payment proofs and his India address. It's absolutely legal for you to get a lawyer in India. It's advisable to contact me and provide more details and info regarding the transactions to help you better.

well you can file a recovery suit against him and if you have taken a cheque for security purposes and if it has got bounced then also you can file for the complaint case. what really matters is how the money was given and for what purpose and you yourself have given it or it was asked by the person to whom you have lent it.

Yes, it is completely legal for a foreign national to engage an Indian lawyer. Indian advocates are permitted to represent foreign clients in matters arising within India. If the transaction took place when the opposite party was in India, Indian courts can assume jurisdiction, even if he is presently working outside India. A case may be filed based on where the cause of action arose, where the agreement was executed, or where payments were made or breached. You can pursue the matter through a duly authorised Power of Attorney in favour of your lawyer, so your physical presence in India may not be required at every stage. Generally, you should keep ready documents such as the agreement/contract, proof of payments, communication records (emails, messages), identity proof, address proof, and any evidence showing the transaction occurred in India. Religion does not affect civil or recovery matters. Muslim personal law applies mainly to personal issues like marriage, divorce, inheritance, etc., and will not impact a commercial, contractual, or recovery dispute. Your case will be decided under applicable Indian civil and commercial laws, not on the basis of religion.

First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime file a recovery suit in the court to claim your money back along with compensations.
