First of all rather than going legally you should serve him a legal notice and in that notice you must write that either return my money back or face legal action which will be at his own risk. After that if he fails to give you a satisfactory reply then you can anytime file a recovery suit in the court to claim your money back along with interest. For more legal assistance I am just a call away.

If you have given friendly loan then you need to first hire an expertly advocate n not the one who doesn’t have sufficient expertise in such cases ! In your case, first a legal notice needs to be sent via your advocate for demand and thenceforth you suit for recovery B in touch

A loan given to friend does not fall under category of commercial loan and a case for recovery of such amount cannot be filed in commercial court. rather you must file a case in civil court under summary proceedings. this would result in your recovering the money in shortest possible time. should you have any queries feel free to contact me

1. You can go for a civil recovery suit in civil court. 2. Or in magistrate court if you have a cheque in relation to that transaction. 3. For going to commercial court your matter needs to fall into the category of commercial disputes mentioned in Sec 2(c) of commercial court Act, 2015. 4. From the facts given by you, your matter relates to the civil recovery suit.
