How to present cheque for lessor amount than the original

07-Sep-2025 (In Recovery Law)
So I gave a loan to someone for Rs. Ten lacs and received a cheque in return the party paid me 1 lacs amount and went rogue and stopped picking my calls. Now I know if I present the cheque for full amount it the cheque bounce case will be invalidated . When I asked the bank to present the cheque for lesser amount than that states according to section 56 they said it is not possible. What is the solution Section 56 says that the payee can negotiate the cheque for a lessor

Don't worry, your situation is not a dead end. We can take action. The law you're referring to, the Negotiable Instruments Act, provides a way forward. While the bank may have told you they can't present it for a lesser amount, the solution lies in a specific legal procedure that many people, and even some bankers, are unaware of. You have the right to make a crucial endorsement on the back of the cheque. We know exactly how to handle this so that a cheque bounce case is legally valid and enforceable. The key is to correctly document the part payment on the instrument itself before presenting it. This is a very precise legal step, and doing it wrong can jeopardize your entire claim. We can guide you through this process and ensure it's done correctly to get your money back. Don't let the debtor escape their obligation.
