hello, if you have given a friendly loan a recovery suit will be filed and if you have given Loan in a commercial transaction a commercial case can be filed against them, if you have tried to contact them and they are not responding you can file a zero FIR and file a criminal case

you mention having advanced ₹2.5 lakhs about 30 months ago on trust, and the borrower has not repaid. This is a clear case of money recovery, which falls under civil law and, depending on facts, may also involve criminal remedies if there was fraudulent intent. Since the transaction happened 30 months back, it is still well within the general limitation period of three years for filing a civil recovery suit under the Limitation Act, 1963. The appropriate forum would be a civil court in Mumbai, since you wish to file there, and jurisdiction will depend on either the place where the money was advanced or where the defendant resides. You can initiate proceedings by first serving a legal notice demanding repayment within a specified time, failing which a civil recovery suit or a summary suit under CPC can be filed for faster adjudication. For filing a money recovery case, the most important step is to establish the base of transaction and supporting evidence, because the court will rely strictly on proof. Since you loaned ₹2.5 lakhs about 30 months ago, you must first prepare a record of all details in a structured form. Begin by noting the transaction details – date(s) when money was given, exact amount, and mode of payment (cash, cheque, bank transfer, UPI). If it was through bank, attach statements, cheque copies, or transfer slips. Next, check for any written records such as a loan agreement, promissory note, MoU, or at least a signed acknowledgment from the borrower, along with any security documents like cheques or property papers. Collect communications including WhatsApp chats, SMS, or emails where the borrower admits taking money or promises repayment, and keep printouts/screenshots ready. List out witnesses, if anyone was present when the loan was handed over, with their names and contacts. Record any repayment attempts – part-payments made, receipts, or verbal/written promises of repayment with dates. Also confirm whether a legal notice has already been issued; if yes, preserve its copy and postal acknowledgment. Finally, ensure you have the borrower’s current address for serving notice and filing suit.

Since the money was given around 30 months ago, limitation (time period for filing a recovery case) may be an issue. Generally, civil recovery suits have a 3-year limitation period from the date of loan or last acknowledgment of debt. That means you likely still have time, but it's important to act quickly. 2. Where to File the Case The place of filing depends on: Where the borrower resides, or Where the transaction took place (loan was given/received). If the borrower is in Mumbai, then the case will have to be filed in Mumbai court (not
