23-Dec-2025 (In Recovery Law)
I have given money to friend in USA. Now we both are in Telangana but different places. He said he will pay in my locality twice in Hyderabad. So can I file civil suit in my jurisdiction. Because he is in nizamabad which is very far. So based on his repayment location jurisdiction I can file?

Yes. Under Section 20 of the Civil Procedure Code, 1908, a civil suit for recovery can be filed where the defendant resides or where the cause of action wholly or in part arises. If the borrower has clearly agreed or admitted that repayment is to be made at your locality in Hyderabad, then part of the cause of action arises at Hyderabad. Courts consistently hold that the place of repayment is a valid jurisdiction, even if the loan was advanced elsewhere or the defendant resides in another district (Nizamabad). An express promise or acknowledgment regarding repayment location (WhatsApp, messages, emails) strengthens jurisdiction. Therefore, you are legally entitled to file the civil recovery suit in Hyderabad, provided you plead and prove the agreed place of repayment. Drafting must specifically mention this to avoid jurisdictional objection. Early legal notice further fortifies your case.
