Funds transfer to wrong account by error

Transferred big amount to wrong account by error as other account name was same as mine. The account has been dormant even before the transfer, bank where amount is transferred is not able to contact the account holder & without the consent is not able to reverse my amount back to me. RBI ombudsman has closed the complaint stating bank has followed required process without any further appeal option. I need the funds urgently as i am out of work since last 1 year.

File a civil suit for recovery against the account holder and seek court direction to bank to freeze funds. You may also file police complaint for wrongful gain. Court can order refund if claim is proved. Act promptly.

If amount is small → recovery through bank coordination works. If amount is large → immediately send legal notice to beneficiary + bank. Time is crucial. If amount is already withdrawn, recovery becomes more complicated.

File a civil suit for recovery against the account holder and seek court direction to disclose KYC details. If wrongful retention is dishonest, lodge a police complaint. Ombudsman closure doesn’t bar civil remedy. Act urgently.

If the amount was transferred by mistake to a wrong account, the beneficiary cannot legally retain the money. Even if the bank cannot reverse it without consent, you have a civil remedy. You may file a civil suit for recovery against the account holder for money paid by mistake under Section 72 of the Indian Contract Act. The bank can be made a formal party to disclose account details. You may also lodge a police complaint for criminal breach of trust or cheating, if there is dishonest retention after notice. Since the Ombudsman has closed the complaint, your next remedy is through civil court. Send a final legal notice to the beneficiary and bank before filing suit. Limitation is 3 years from date of transfer. Act immediately to protect your claim.
