Fight of set off against alleged claim which is sub judice matteric

Can you please apprise whether a bank can exercise right of set off for recovery its alleged credit card dues where a Consumer Court has granted decree against the Bank & they filed appeal against that decree which is yet to be heard by state commission.

No bank can disobey the order of a court and if the same has been appealed then also during the pendency of the same bank cannot take any step which could jeopardise the complainant. If you have been notified with any such occurring, file an urgent application before the appellate forum where the matter is pending and seek immediate stay over the same.
