Once an ex parte order is passed in favour of the complainant and the limitation period for setting it aside has expired, the decree attains finality. You are fully entitled to initiate Execution Proceedings before the competent court at Secunderabad to enforce the order. In an execution petition, you may seek attachment of movable and immovable properties, garnishee orders, salary attachment, bank account attachment, or any other coercive measures permitted under the Code of Civil Procedure to recover the decretal amount. The Executing Court does not re-examine the merits of the case; it only ensures compliance and satisfaction of the decree. Ensure that you file a certified copy of the judgment, decree, and supporting documents along with your execution petition to expedite the process. Any attempt by the judgment debtor to delay or avoid payment can be legally restrained through execution mechanisms available under CPC.
