DOST ON TIME PAYMENT DENE SE MANA KR RHA HAI

Mere dost ne mere naam per kreditbee/amazon pay MobiKwik au bank federal bank insbse loan lia tha 5/6 mahine pehle but from last 3 months he is not paying EMIS on time usne bola usko koi financial issues chal rhe hai. Toh 2 month mene kr di emi and uska issue abhi b same hai ki pese nhi hai hote hi de dunga.... But the thing is emi and recovery wale toh mere ghr aa rhe hai now what should i do in this case

First of all rather than going legally you should serve your friend a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. And also serve a notice to the bank officials also to convince them about the situation or else they can always approach the court and file a case against you under section 25 of Payment and Settlement Act.

If the loan is procured on your name, you would require to clear the same. However you can sue your friend for recovery in a separate manner. Proof and mode of payment is the important evidence in recovery matter. We can send a legal notice before filing any case against your friend. Feel free to contact. Thanks
