DOST ON TIME PAYMENT DENE SE MANA KR RHA HAI

Mere dost ne mere naam per kreditbee/amazon pay MobiKwik au bank federal bank insbse loan lia tha 5/6 mahine pehle but from last 3 months he is not paying EMIS on time usne bola usko koi financial issues chal rhe hai. Toh 2 month mene kr di emi and uska issue abhi b same hai ki pese nhi hai hote hi de dunga.... But the thing is emi and recovery wale toh mere ghr aa rhe hai now what should i do in this case
First of all rather than going legally you should serve your friend a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. And also serve a notice to the bank officials also to convince them about the situation or else they can always approach the court and file a case against you under section 25 of Payment and Settlement Act.

If the loan was taken fraudulently you could have filed an FIR against your friend, but since you also paid some of his emis it clearly indicates that you were aware of it, so in this case you can send a legal notice to your friend and if he still does not pay you back file a summary suit (civil).
Yadi loan dhokhadhadi se liya gaya tha, to aap apne dost ke khilaf FIR darj kar sakte the, lekin kyunki aapne uski kuch EMI ka bhugtan kiya hai, yah spasht roop se darshata hai ki aapko iske baare mein jankari thi. Aise mein, aap apne dost ko ek kanuni notice bhej sakte hain, aur yadi vah fir bhi aapko paise wapas nahi karta hai, to aap uske khilaf ek summary suit (civil) daayar kar sakte hain.
