Delhi local Area building/ floor Contractor Fraud

We have a written agreement with local area (Delhi) contractor to build my 3rd floor with material As per agreement we have to pay 80% amount during the work and 20% after completing whole my floor. We have given more than 80% payment and he is not building my floor. Now he is asking more money from remaining 20%. Even we have given him more amount but still he is not working. Agreement time was 2 months. BUT 3 MONTHS is over. He says I don't care any lawyer,police,Pm,cm He me please

You have a valid remedy if there is a written agreement and proof of payments. Preserve the agreement, payment receipts, bank records, photographs, and chats. Send a legal notice demanding completion of work or refund of the excess amount paid. If the contractor still fails to comply, you may file a civil suit for recovery of money and damages for breach of contract. If there was dishonest intention from the beginning, a criminal complaint for cheating may also be considered.

The contractor has prima facie breached the terms of the construction agreement by failing to complete the work within the agreed period despite receiving more than the agreed payment. His demand for additional money contrary to the agreement is not legally justified. A legal notice may be issued seeking completion of the remaining work or refund of the excess amount paid, along with compensation for delay and losses. In case of non-compliance, appropriate civil and other legal remedies may be pursued before the competent court.

First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime file a recovery suit in the court to claim your money back along with compensations.

Since you have a written agreement and have already paid more than the agreed 80%, the contractor's refusal to complete the work amounts to breach of contract. First, send him a legal notice demanding completion of the construction within a specified time or refund of the excess amount with compensation. Preserve all evidence, including the agreement, payment receipts, bank statements, WhatsApp chats, call recordings, and photographs of the unfinished work. If he still fails to comply, you may file a civil suit for recovery of money and damages, and if it is established that he induced you to pay money with dishonest intention from the beginning, a criminal complaint for cheating can also be lodged with the local police. Please share the agreement and payment details with a local advocate for appropriate legal action.

You may immediately issue a legal notice for breach of contract and stop any further payments. Preserve the agreement, payment proofs and chats. You may file a civil recovery suit and, if cheating is involved, lodge a police complaint.
