The conduct of the recovery agents, as stated by you, is prima facie illegal and in clear violation of RBI guidelines and settled law. Recovery agents have no authority to contact or harass third parties such as your father or relatives who are neither borrowers nor guarantors. Such actions amount to breach of privacy, intimidation, and unfair recovery practice. You should take immediate action: 1. Issue a formal written complaint to the bank (Standard Chartered) demanding: - Immediate cessation of third-party contact, and - Disclosure of how your relatives’ contact details were obtained. 2. Lodge a complaint before the RBI Ombudsman for violation of fair recovery practices. 3. Preserve call recordings, call logs, and any messages as evidence of harassment. 4. If intimidation continues, file a police complaint for harassment and unlawful interference. At the same time, note that the underlying debt may still be legally recoverable subject to limitation. However, recovery must strictly follow due process and cannot be enforced through coercion or harassment. Assert your rights firmly—unlawful recovery tactics are actionable and courts take a serious view of such conduct.
