Company suffering loss any action to delay claims of employee

My company is in loss from past six months and and are unable to pay the salaries to our employees and before any cases are filed and we want to have 6 months time for all pending payments and refund. What should be the plan of action?

Any such relief can only be granted when any of your employee, or the creditor proceeds before the court. At this stage you can only request the concerned parties to bear with you for a while before you clear their dues/salaries.

Please let me know how many employees are there ? First of all you should discuss your problem with your employees, I think the matter will be settled by this way. If they are not ready to wait, let them file a case in Industrial Dispute tribunal then we shall deal with the matter.

Have an open dialogue with all your employees and thereafter send a written letter in general that due to extraneous circumstances we are unable to pay salaries and therefore require 6 months to take appropriate steps to rectify the issues at hand.
