section 145 under negotiable instrument Act deals with the affidavit of evidence, now on the basis of that affidavit of evidence your case will be heard and someone should be issued to the accused, negotiable instrument Act uses a mixture of criminal procedure and civil procedure, while the criminal cases don't have affidavit of evidence negotiable instrument Act does allow affidavit of evidence at the time of the filing of the complaint as being done in code of civil procedure.
