Buying land in partnership and building apartment -misleading promise

02-Feb-2026 (In Recovery Law)
I lent someone 7lacs during 2014 to purchase a land in Dombivali village and then to build a building where I would be getting a flat for 50 lacs once building is ready in partnership with any builder on a ratio of 40:60. It never happened and then I came to know that the building were not purchased as his name was not there nor it was sold. He gave me land paper with some other people name. It's a cheating case and I want to recover my 7 lacs. I have court paper for the money lent to him.

You can file a recovery suit for ₹7 lakhs with interest based on documentary proof. Simultaneously, a criminal complaint for cheating, breach of trust and forgery can be lodged to pressure recovery as per the concerned provisions of law.

Based on the facts, you have a strong legal case to recover the ₹7 lakh. Since the promised land/building deal never materialized and the property is not in your name, you can pursue: (i) civil suit for recovery with interest, (ii) legal notice to demand repayment, and (iii) if there is evidence of dishonest intent, a criminal complaint for cheating (IPC 420). With your court papers and documents, legal action is the most effective way to secure your rights. I can assist in sending the notice and filing the suit.

From your facts, both civil and criminal remedies are available. If you have written proof of lending ₹7 lakhs, you can file a civil suit for recovery with interest. However, limitation is important. For money recovery, limitation is generally 3 years from date of loan or last written acknowledgment. If there is any acknowledgment or promise in writing within 3 years, limitation may extend. Since false representations were made regarding land and flat, you may also lodge a criminal complaint for cheating and criminal breach of trust. Immediately issue a legal notice and examine limitation carefully before filing proceedings.
