Builder delay, non-performance & extra payment demand

14-Apr-2026 (In Recovery Law)
I entered into a construction agreement for a residential project and have made payments as per milestones. The builder has delayed the work for over a month and stopped execution multiple times. A 14-day notice was issued, but even after that, work has not properly resumed. They are now demanding additional payments like PDC which are not part of the agreement and making work conditional. Can I legally terminate the agreement and claim refund for unexecuted work and delays?

You have legal grounds to terminate—delay in execution and imposing conditions outside the agreement (like PDCs) amount to breach. However, the right strategy here is critical: termination, refund, and damages must be positioned carefully based on your agreement terms, payment structure, and documented delays.

Greetings. The terms of the construction agreement and the demands being issued by the builder have to be analysed to further assist you in your query. Termination can be done legally incase of deviation from the agreement. Please contact for further discussion.
