Bank is telling me to accept possesion instead of refund

I had paid all the alotment money back in 2011 when i booked the flat wity the builder but till date he has not given me the possession. Meanwhile i got decree againstb the builder which now pending before Excecuting court and I have recived 30% of total refund. Now sometime back i spoke to the bank from which i took loan for this flat under subvention scheme for the settlement. Now the bank says that flat is near completion and they will attach that under SARFesi to recover the amount.
First of all rather than going legally you should serve him/her a legal notice and in that notice you can write that either pay my money or face legal action which will be at your own risk. After that if he/she fails to give you a satisfactory reply then you can anytime file a suit in the court to claim your money back along with compensations.

based on the facts. it seems like you haven't gotten a recovery notice yet. further these facts are very less to give any apt advice. we need to know whether the bank is going for recovery procedure. what is the amount of loan and whether you have received any notice or not.
