Bank filed legal under N.I. act for non payment of Loan EMI.

What will happen if I fail to appear in court due to some personal reason ? What can be the court judgement against me when I am unable to pay the personal loan EMI due to financial crisis?
The proceedings under NI Act are criminal in nature and non appearing in court can lead to arrest. I would advise you to be careful and serious about the proceedings. We will have to tactfully deal with all of this and get you out of the issue.

Sir, the person should not fails to appear before the court, the court may hold the person in contempt or issue warrant against such person. So the person should not avoid appearing before the Court.
please present in court and disclose all such things in your defence.

Hi,
Gojng by the little facts provided by you. As you are not paying the loan emi and defaulted the same. The Loan department of the concerned bank will file acase against you whereby they can even ask for bailable warrants against you, them non bailable warrants and attachment of your personal propery. My advice would be to hire an advocate whi can represent you as well as buy you sometime to pay the remaining loan.
