Appeal Filed for Delay in Execution of NCDRC Judgement

15-Mar-2023 (In Recovery Law)
I have won the case against builder in NCDRC & but as expected he did not refund the money & executed the NCDRC judgement. I have filed the Appeal in NCDRC for non execution of judgement by builder. In the mean time builder has approached me for negotiating the final amount plus interest ordered by court. NCDRC ordered for Principle + Int @9% while builder is offering Principle+4% & that too payment will be made in 8-9 installments. Shall i take it or fight the case in NCDRC & then may be further in SC.Please advise

If the court has ordered for principle + 9% upon the builder then he is duty bound to obey the court order to avoid any adverse order against him. It depends on you whether the principal + 4% will satisfy you or not.

You better take the amount from builder and gave peace of mind. You never know if covid knocks the door and things become sluggish. Compromising for certain amount worth your peace. Recommend you to settle the matter asap

In such a scenario it is advisable to have proper documentation stating the terms and conditions of settlement in place even if both parties agree for payment in the manner as being proposed by the builder. Kindly contact for further detailed discussion as Ill have to go through the documents before providing final opinion.
