Amount transferred through UPI without any agreement/promissory note.

29-Dec-2025 (In Recovery Law)
In April 2025, I transferred ₹1,50,000 via Google Pay to my friend (₹35,000 + ₹90,000) and his wife (₹25,000) based on trust, without any written agreement. Since then, he has neither repaid the principal nor interest and keeps postponing despite daily follow-ups. His conduct has caused severe mental stress. All payments are traceable through bank and UPI records. Kindly advise on legal remedies for recovery.

You have a legally recoverable claim. Even without a written agreement, the UPI/bank transfer records conclusively prove payment and constitute documentary evidence of debt. Courts recognise electronic fund transfers and subsequent conduct as proof of a loan/financial transaction. Immediate legal remedies: Legal Notice (Recovery Demand): Issue a formal notice demanding repayment of ₹1,50,000 with interest within a fixed time. This often triggers settlement and strengthens your record. Civil Suit for Recovery of Money: File a suit based on documentary evidence (UPI statements, bank records, chats/messages if any). Written agreement is not mandatory when payment is admitted or proved. Criminal Action (if facts permit): If there is evidence of dishonest intention from inception, false assurances, or diversion of funds, a complaint under IPC Sections 420/406 may be maintainable. This is fact-specific. Summary Proceedings: Depending on jurisdiction and admissions, expedited remedies may be explored. Preserve evidence: Bank statements, UPI transaction IDs, follow-up messages, call logs, and any acknowledgments. Stop informal follow-ups; proceed legally. Bottom line: The transaction is traceable, provable, and enforceable. Prompt legal action will materially improve recovery prospects and curb further delay.
