Acquiring a temporary shop from a popular place from a party

u/s 420 / 406 /506 /34 IPC , Paid advance for acquiring a shop with wrong agreement .It was signed and some advance given, Later told him to refund advance as agreement is wrong within a week time
Other party Notarized the agreement( unethical & no copy given to me) & started demanding balance balance amount. Both side FIR done . I have not done any mistake. No proof is there from other party side
Can it be quashed at Kolkata high court
