A man took money from my minor sister how can I recover it back

28-Jun-2023 (In Recovery Law)
My sister is 14 & started to talk to a 24 year old guy he hided his age. After stopping her. We had no idea that they continued there talk & he asked her to give money whenever needed & she gave almost 2.5 lakhs in innocencey. Everyone in family asked her if he actually blackmails her or something else but she denied each time. We've proof that the money is given to that guy. We read their msgs & forwarded all the screenshots to our phones. Now my family is worried to complain. Will the police send my sister to any rehabilitation center etc?? Please help. Or we can have our money back? Help!!!

the money can be recovered and there is no danger for your sister. But you have to make sure that your sister gives testimony against that guy. you should make complaint but after proper consultation.

Certainly, not she got immunity under minor age, second, the act of the boy is certainly a cognizable offence, you must lodge an FIR against him, police will take action against him.
In any case if Police reluctant to take any action, you can go to court of competent jurisdiction u/s 156/3 crpc.

First of all there no question of sending any minor into rehabilitation center, as it can be done only in specific cercimstances e.g. If minor is delinquent, unsound mind etc. Secondly, if you have proof/ evidences you can get the legal notice issued through your advocate for recovery and file a civil suit for recovery, depending upon the gravity of act/ ommission/ commission you can invoke section 154 Cr. P.C. For registration of FIR under the provisions of Indian Penal Code. Police generally do not harras the victims. Detailed advice can be tendered only after perusal of records.
