Younger brother captured parental property wants to claim a share

I reside at jamshedpur jharkhand our deceased parental property which is still not registered by my parents after his death our younger brother capture and construct illegal construction witout permission of two brother and letout and receiving about 80000/ rent we me and my 2hd brother object younger brother thretend us for murder we both brother resided in jharkhand my question is can we file a case against our younger brother from jharkhand instead of patna pls.advise us properly.
Property of your parents.....then you all have equal rights over the same. You have to file the case at the place where the property is situated. So, if it is in Jamshedpur, then file case there. Municipality/Corporationsubmit one application there that you have objection to the construction as you both are co-owners of the property and submit such applications in all required Government Department. And without any delay file case.
