Will Probate Registered need to check ?

I am not being given a copy of the will by my sister even after repeated asking. They simply say I cannot stay there as thats whats mentioned in the will. The property is in our my parents name located in Marine lines Mumbai, Parents have expired decades ago. I and my family and her family have been living on the property since 60 years. She was closer to my parents.. All of a sudden a week ago this issue has come up we were a peaceful Christian family up until now. What steps do I need to take? Can they have done the probate without my knowledge? How do I check? How do I check if the will is registered? What all do I need to do/ check.

Dear Querist,

Probate cannot be granted without service of citation upon you or your consent.

To check probate granted or not, check on Bombay High Court website or take help of am advocate.

To check whether will is registered or not, the records at Dy registrars office needs to be checked, a search clerk or an advocate can help you.

If you find probate is granted without sevice upon you, challenge the same.

You first would have to check the probate or la with the Bombay high court. If it is filed then we would have to contest it.

If it is not filed yet then you can file a caveat which means the probate will not be granted without your knowledge.
