09-Aug-2023 (In Property Law)
My grandfather own a house which further divided into three floor among three sons . Now, We are 4 siblings (2 son and 2 sisters) all are married . My father want to do a will of 1 floor (he got from grandfather ) in favor of mother and sons .so that sisters can not claim share in future . What are possible ways my father can choose to define shares of mother and sons ?

First, it needs to be understood that whether the property is self acquired or ancestral. In the former, your grandfather by way of a registered will can definitely exclude the sisters out of the estate. In the latter, he can only transfer his share in the name of your father and uncles.

I have perused your query. See once your grandfather had divided the property amongst 3 sons the property cease to be an ancestral property and becomes the self acquired properties of the respected 3 siblings. Now, you father through a Will can bequeath the same to anybody of this choice excluding your sisters. For further consultancy and legal services you may contact us.

Hello I have perused your query. If the your father inherited the property from your grandfather then it is an ancestral property and therefore he can only make a will regarding his share in the property but not his daughter's or son.

Each and every person holds an equal share in the ancestral property inherited by your father.
