Whose signature is required for Partition.

Do the grandchildren need to sign the partition deed. If the Grand father and Grandmother is dead. The partition of the property is happening between 4 sons and 1 daughter..

Dear client, based on your question that the grandchildren (or their legal guardians, if they are minors) may need to sign the partition deed,as they hold a legal share in the property. If the property was self- acquired by the grandfather and he passed away without a will (intestate), the property would be divided equally among his legal heirs ( the 4 sons and 1 daughter in the case).The grandchildren would not need to partition deed unless one of their parents has passed away. 1.the partition has to be signed by all the parties or the legal heirs of the property 2. the children of the grandmother and grandfather are to be signed in the partition 3.if the grandmother and grandfather children are dead then the children of deceased has to be signed
