Who is suppose to repay the damages in the joint owned property

Have a joint house with uncle. We r on the first floor and they stay pn 2nd. Our walls have been damaged because of water leakage in thr area.. who is supposed to pay for the repair.
If the wall has been damaged because of any leakage due to your uncle on second floor you are entitled to claim money for the same.
We have appropriate remedy to file a case against them if needed.

please, clarify first that whether you and your uncle both are co-owner or living in inherited property?
if you are living jointly then both are liable for damaged walls and burden on both of you, if you are living alone from your uncle then your uncle is liable only.
