Whether property biyana made in 2013 valid till 2016

We are living in this property from many years now but one of our known party with forgery signed a biyana -- whether that biyana signed in 2013 is valid till 2016 -- they have filed a case against us

Dear Sir,

Whether the biyana receipt is valid or not is question that will have to be determined by the Court now that the case has been filed. Further, it would be easier to advise the course of action once you share the documents.

Period of limitation is three years from the date when the cause of action arose i.e. frustration of agreement happened or one party denied some right to the other in terms of the agreement to sell etc.

The Biyana or earnest money you talking about is only valid for three months that is 90 days.How a case has been filed against you on what basis.Therefore you acquired this property from and what basis of documents please specify to know the correct answer contact for further details.

See 'biyana' does not have any specific date of expiry. It depends on the consideration for which it was done. If the consideration gets diluted by time then the biyana gets infructuous. You should consult as the facts does not seem clear.

If you want to know limitation period for specific performance suit then it is 3 years. But as you have mentioned that a case has been filed against you so all details documents and case files are required to be examined to answer your question.
