What to do there is a property dispute

sir we have brought a eviction cam title suit with my uncle we have a registered partition suit since 1988 but my uncle is niter giving rent nor evacuating my house so we lodge a case on 2011 now we have closed our witness(Gawai). sir since there is no rent agreement within us can you please tell me how and which case study can help me to get rent from past 8+3 years which we have calmed so that we can get justice as my uncle is enjoying my property without paying anything I will be grateful to you .

Yes, if not partitioned the said property they are claim their rights over the said ancestral property. Your father's sisters have to issue a notice for the same to your father for partition. Afterwards they have to file civil suit for partition and separate possession and not binding the subsequent sale deeds before jurisdictional civil court.

As i understand your query you have filed eviction suit against your uncle for evicting your house. You have filed the same through some lawyer. He will help you to get case law. Further ask your lawyer to go through rent control law.

For apt and suitable advice, you need to provide Plaint, Written Statement and other documents of both Suits. If your uncle has admitted himself as Tenant of your father, there is legal right to claim the arrears of the rent. However, after three years the same is barred under law of Limitation. Only the details of the fact can guide us to suggest you properly.
