What to do in case of property dispute between the brothers
16-Jun-2023 (In Property Law)
My grandfather were 4 brothers & my grandfather is younger. At the time of survey elder brother surveyed govt acquired property on his name. Where all four stayed in a joint family.now elder brother is not sharing the property to the younger ones. We are Hindu &sc in cast.
Survey entry is not the proof of title. All other brothers claim their title by filing partition, either through Panchyat or the court. It is also available for them to sell their share, on the basis of jointness of the family property.
All the brothers have got equal title and definitely equal share in the property. Entry in Survey Records neither creates title nor extingushes the same.
You need to institute a Title Partition Suit in the Civil Court to get your definite share in the property.

As per hindu law property of the family belong to all share holders irrespective of the fact property is on someone's name. If karta of the family is not ready to divide the property in equal propotion among all of its share holders, contact a good lawyer and file a partition suit.
