What to do if home loan is taken on property under dispute
06-May-2023 (In Property Law)
I have taken one duplex house from a builder in 2011 and taken possession in 2015 however I have not able to use the house as of now as the area is not developed as explained by the builder in agreement. I have a loan ongoing from last 4 years. Now there is some dispute arising on the land on which building is constructed .please suggest what I should do in this situation. Do I need to continue paying Emi of my home loan . Please suggest what is the best option here.
Here the builder has not completed the work as committed by him. He has handed over the property without completion.Hence he is liable to be prosecuted as per law.you can file a case against him at consumer court and in criminal court.

What dispute is it, kindly specify. Yes you pay the EMI if you are not questioned yet. Is any case or suit filed against you or what? Or is there any injunction order on the said land?

As far as loan is concerned bank has nothing to do with the property condition.
Now as you said that the work is incomplete then the must not have completion certificate so they fall under ambit of RERA . You can file complain at rera and get relief and compensation.
