What to do if a notice is received on a SRA flat to evacuate it
21-Jun-2023 (In Property Law)
My neighbor has to evacuate his flat after receiving 24 hours notice for evacuation. He had bought this sra flat 13 years ago. What can he do now?
As per your query,
Please note that, the flat allotted to the concerned slum dweller under the S.R.A. is not transferable for the initial period of ten years. If your friend has purchased the same after 10 then it can be considered as valid transfer other wise he has to evacuate the same. At the most you can file a suit in the concerned court asking not dispossess your friend without following the due process of law.

This is my response to you:
1. After the 10 year period is over the SRA flat can be sold;
2. Since the notice has come then immediately approach the court and file for stay;
3. Then he can file for injunction and rights to not create third party interests on the property;
4. Engage a lawyer and seek immediate relief in courts.

What is the content of the notice?
Who has sent the notice?
How many years later has the original owner sold the flat ?
Need to see the agreement of the flat to understnd more detailed clauses only then can give you a better remedy
