What remedy can be taken against builder for delay in work

Sir my builder has take 100 % payment from me three month ago but not fitting the grills and collaspable gate in my flat .Repeted reminder has been given by mail and message but still builder not fitting it. What should we do?

File a case in district consumer forum, he will come running to you and will do all the needful... was there any money receipts or any proof that you had made a full payment to the builder for fixing and fitting grills and collapsible gate. Before thinking a legal action against anybody you need to carry some proof or supporting documents to claim your rights in law. Legal proceeding can be initiated by a complaint lodged at the local police station but the genuineness of the transaction and claim shall be tested in the court of law. If not, can you prove that the money was given to the builder in the presence of someone, at two witnesses are required to lodge a FIR with the local police. Remember court does not function on vague and wild cries, the onus is upon the person who brings an allegation against other. Once you are able to prove your claim, the onus shift upon the other person that to defend him/herself. If not how you are going to prove this.

In the absence of any documentary or witnesses, I suggest you to make a complaint to the consumer forum or the promoter cell. Should you need any further assistance you may contact me.

You shall get immediate reliefs as possession, compensation for delay, other irregularities by the Developer, compensation for your mental agony by filing a simple case in Consumer Dispute Redressal Forum, plenty of my clients in Kolkata got immediate reliefs accordingly. All the best. Regards
