During purchase or sale of flat under co-operative society, an amount equal to 10% of cost of property as per Govt. rate is charged by the co-operative society. Is this legal?

The Cooperative Society runs by its own byelaws. If such rate is prescribed in the bye laws or laid down by any legal / valid order, it is binding, else it is illegal. First of all seek information as to the basis for levelling the charge.
