What is the procedure of getting money back
21-Aug-2023 (In Property Law)
I had earned a lot of money when I was in my 20s. I used to give all that money (in cash) to my elder brother. By accumulating that money, my brother bought a piece of land and got registered it in his name. Now he refuses to give me my property back since it was brought from my money. What should I do?
u used to give money to your brother in cash where there is written that u have given money to your brother saving that money for u and in future if u want that money he will give to u. for any legal action written proof is reqyired. without written proof or without any witness u cannot take legal action.
You need to establish solid proof that the money you had given to your brother is accounted for and it was on a liable to return basis or accountable basis that you had paid him for. If he has deceived you then filing of a civil suit subject to grounds of limitation.
In this case you have paid in cash to your brother. Is there any evidence on record which proves that he has taken this money from you and invested in this land. If you wish to take legal recourse you need to back up your claim with sufficient evidence otherwise your efforts will fall flat. Please give details of any evidence.
