What are the charges and stamp duty for Relinquishment deed

29-Sep-2025 (In Property Law)
I jointly own a DDA property in Narela (expandable floor, 22.5 m²) with my wife — each of us holds 50%. I want to transfer my 50% share to my wife. Please advise on the legal options, costs, procedure and tax implications. Questions to ask the lawyer (concise): 1. What are the legal options to transfer my 50% share to my wife — relinquishment deed vs gift deed vs sale? 2. For a relinquishment deed, what stamp duty % and registration charges apply (Delhi/DDA rules)?

The stamp duty and registration charges for a Relinquishment Deed, a document through which a co-owner or legal heir gives up their rights in a jointly owned or inherited property, vary based on your specific location and whether any money is exchanged.

You can transfer your 50% share by Gift Deed or Relinquishment Deed. Since it’s between husband and wife, stamp duty in Delhi is nominal (₹200 + 1% registration). No tax applies as transfer to spouse is exempt. Sale deed attracts full duty (~6%), so avoid. Gift/Relinquishment deed is the best option.

You can transfer your 50% share in the DDA property to your wife either by relinquishment deed, gift deed, or sale deed. Since this is a transfer between husband and wife, the most practical and cost-effective option is either a gift deed or a relinquishment deed. Relinquishment Deed: Usually used where co-owners surrender their share in favor of another co-owner. In Delhi, stamp duty is a nominal ₹100 for family members (including spouse), plus 1% registration charges on the value declared. Gift Deed: A gift deed between close relatives (spouse included) also attracts only concessional stamp duty in Delhi (₹200 stamp duty + 1% registration fee). Sale Deed: Technically possible, but involves full stamp duty @ 6% (men) / 4% (women) of circle rate value plus registration charges, hence costlier and unnecessary in your case. Procedure: Draft the deed (gift/relinquishment), get it stamped, and register it at the sub-registrar office with both parties’ presence and two witnesses. DDA records should also be updated after registration. Tax implication: No capital gains tax if transferred via gift or relinquishment to spouse, as per Income Tax Act. Sale deed may trigger capital gains liability.

Hi there, options to make your wife 50% shareholder are: 1. Make a MOU and have her name updated in all relevant authorities; 2. Make a relinquishment deed wherein you'll relinquish half of property in her favour against some consideration; 3. Make a gift deed in favour of wife. However, in order to determine best way for you I need details as to history and nature of property involved. Stamp Duty will range somewhere around 1-7% + fix charges. It's advisable to contact me and provide more details to assist you better.

Transferring your 50% share in a DDA property to your wife in Narela can be done via gift deed, relinquishment deed, or sale deed. Each option has implications for legal process, cost, and taxation. Legal Options for Transfer Relinquishment Deed: Typically used for co-owners relinquishing their share to another co-owner, particularly within the family. This is practical for joint ownership transfer to a spouse. Gift Deed: Enables transfer without consideration between close relatives, including spouses. Stamp duty concessions apply for gifts within the family. Sale Deed: Theoretically possible, but stamp duty is much higher, and tax liability may arise if consideration is paid. Not recommended for spousal transfers.
