26-Jul-2023 (In Property Law)
Hi. My parents married as per Muslim traditions. I am only daughter (28years) to my father. My parents got separated. My father left me too in childhood and remarried. Since then I didn't seen him. Now he has one adopted daughter. Now refusing to give any property, and transferring all the earnings, bought properties on the name of her adopted daughter and my step mother. I am living with my mother. Plz advice me to get my right.

Hello. If it is your father's self acquired property, then he can transfer it to anybody. Your mother can file a suit for alimony and maintenance, for that we will have to look into the date of talak and other details, then your mother can only claim maintenance under section 125 of crpc. We can assist you with that.

All Property under Muslim Law is akin to self acquired property in India, You cannot prevent your father from, during his life time transferring any property to any one. If you are a minor you can claim maintenance, so is your mother ,
