We live in my grandparents house. My father and grandparents are no more. My father has brothers. They haven't been in touch since long. We're not sure if there's a will. We have been living in this house for more than 30 years(more than 13 years after grandparents) Do we have any legal right over this property? We are going through major financial problem. We wish to sell it. Is it possible and will we need to share the money? Please suggest.
If your grandfather and father both have died then being the surviving legal heirs of your father and grandfather, you all can mutually divide the property amongst each other equally or else can file a suit for partition and get the division through court. As per the facts stated by you , It seems that the property was the Self acquired property of your grandparents. Therefore, as per the prevailing law of succession the said property shall devolve upon all the surviving class one legal heirs Of your grandparents (only when there is no Will left behind by the grandparent) in equal ratio. Even if you are in possession, that doesnot destroy the right and interest of other surviving class one legal heirs of your grandparents in whose name the property was. In case you wish to sell the property, then you can only sell your share in the property and you shall also obtain the surviving legal heir certificate from the concerned SDM.
