We have an ancestral property In Delhi. We have only farad as proof . Also electricity bill, water connection and all other bills are in my father's name. I want to know how can we have power of attorney in my father's name or registry of the property. We are hindu.
hello client as you have mentioned tht your ancestral property is in delhi and you are not having any legal documents accept farad in your hand as well as you are having bills of electricity as well as other bill also you are having.
in this matter you need to file a case in court for declearation of property to geylt registered on your name as per law but it is only possible through court only otherwise you may loose your land as delhi government is taking possession of unclaimed lands in delhi as per latest laws passed by delhi government.

Since its an ancestral property. Two things is to be seen first.
1. Has the owner of the property left behind a will or he has died without making a will i.e. died inestate.
2. If without executing a will in your fathers favour. How many class 1 successors are there in your family. Like brother and sister of your father.
If there are any other successors then, the relinquishment deed is to be signed by them and on the basis of this after submitting the succession heir certificate and reliquishment deed, the ownership as to the property will be transfered in your fathers favour.

The farad you have is the document to prove your tittle , moreover the electricity and water bill are the supporting documents.
You don’t need any other document .
If your father wish to sell that property he can sell it off .

First of all, whose name is there in the fard. for example:
if your father’s grandfather name is there or his father name is there then by showing the family lineage you can show he is the owner of the property. By virtue of this Fard your father will be the owner of the property. this is the clear position of law. if he wants to sell the property, he can by way of a sale deed which can be rigistered.
