Want to change the ownership of the flat

After my husband sudden death I want to change the flat ownership. The flat is in his name only. We have a baby also. So who will be the legal heir of his property and how can I change the ownership of the flat by my name?

If your husband dies and your name is not on your house title you should be able to retain ownership of the house as a surviving widow. If your husband did not prepare a will, he died intestate you can make ownership claim against the house through probate process. The right of inheritance is passing the titles, rights, debts , property and obligation to another person on the death of an individual. But there are various consideration like whether the property was self-acquired or passed on from generation the will of the deceased, no. of legal heirs etc.

you and the child will be the primary hairs , later on if he was the the only source for his parents they will have maintenance rights over the property. again it depends on whether there is a loan on that , you should start by first collecting a death certificate at applying for change.
