Since the property is now legally transferred to your name by your mother, your brother does not have any legal right to continue residing there without your permission. You may issue him a legal notice asking him to vacate the premises within a reasonable time. If he refuses, you can file a suit for eviction and seek possession through the appropriate civil court. It’s important to maintain documentation of all communications with him. For a smoother process, it is advisable to consult an advocate to assist with the eviction proceedings. You can file a suit for recovery of possession as your brother is an illegal occupant in the aforementioned property and you being the rightful owner has a legal right to do so. For any further legal assistance please feel free to contact.
