Uncle acquired undivided HUF Land. How to recover my part of land?
02-Feb-2023 (In Property Law)
My fathers are 3 brothers. They have at my village HUF Plots, Land and one house. They have not divided properly yet due to family disputes. My one uncle is residence in village. Few years back my father had taken one portion of farm land from my uncle to stop some dispute but not equally divided. He has Max Farm land portion. @ yrs back my father expired. Now my uncle is started construction over one undivided plot, which we (I and my another uncle) is not agreed but he forcefully construcing because of his relative in Politics and Lawer also. His both son are threatening us against criminal action. pl suggest to get out of this dispute and recover my Equal Farm land, Plot and House.
File a case against him for suit for possession with mandatory injunction as soon as possible ...also file a case against him under section 420 ipc ....the construction is illegal and thus court will pass an order of stay ...
Firstly you should suit for permanent injuction and then file suit for partition in competent court and you can also file criminal complaint against your uncle and if the police doesn't support you then file complaint under 156 cr.p.c
You can approach the court for stay on construction till the division of your property share and can file a sute for permanent injunction and possession of your ancestral property. Nobody can stop you to have your share of lawful property.
