Transmission on death of a member

I am a hindu, joint owner of a flat. After death of the first named owner my father, I was advised to make release deed along with other required documents. One legal heir my brother is not coming to sign the release deed registration due to disputes created by him. My father has nominated me 100%. What are my options if he does not come at all?

You can submit application for nomination without your brother's consent.Nominee shall be trustte or representative to other legal heir.Therefore you can be responsible for other legal heirs.But if nomination is nominated by your father.Then you can nominate for 100% nomination.

Dear Querist, who all are the other legal heirs?
Try to make an application to society on the basis of nomination and with an indemnity bond that if any claims arises, you will settle at your cost. If society agrees then Good. Or else you will have to apply for Succession Certificate.
