Transfer of property left without will after both the parents died

Our both Hindu parents are no more and there is a property registered in our father's name in west Delhi. Would like to know and take support for transfer of the property to us (three sons). All sons are living out of Delhi right now.

In case you parents, father particularly died intestate I.e. without writing a will, then in that case you have option to execute a registered partition deed after obtaining SMC from concerned authorities. that would serve the purpose. in case you want to sell it and want to save stamp duty charges, then altogether different course of action is required. you may contact me for further consultation in the matter. thanks

If you father has not left any will then the distribution will be according to Hindu Succession Act and if he has left the will then it will be according to The Indian Succession Act. U can be in touch with us …

First of all, you have to apply for legal heir certificate from the revenue department under whose jurisdiction the property falls. Once you acquire the said legal heir certificate then you three can get the property mutated in your names. For further assistance please feel free to contact. Thank you.
