If you are the sole survivor after your mother in the class 1 legal heir, then if there is no will, you can transfer the property by filing a succession heir certificate alongwith the application form annexing the affidavit and death certificate.

Hello, I have perused your query. If your mother died intestate then you have an option to create a legal heir certificate in regard to the property and thereafter apply for the mutation of said property i.e. the transfer of title in your name. Charges or a fixed amount of fee is to be paid for the mutation of property. Request for the change in official records is done through an application form with court fee stamp. The form must be duly filled, signed and submitted with the Commissioner of the Revenue Department. For any further information feel free to reach out to us.

in case there is no will from her you have to aply in court for a letter of administration and certificate of inheritence. and after getting this succession certificate you can apply with registrar properties to get this property be transferred in your name on basis of Succession.
