transfer of property by mother with different name in document

We have a land plot about 2800 sq.ft. in a municipal area.The plot is resister on my mother's name.Now she want to transfer the registration to me and my brother.But my father and mother's Surname and our surname is differant.In this situation how she can transfer the plot to us.what are the legal process for this?
She can transfer it to you and your brother as gift .there is a provision in law to transfer the property by gift. There will be no issue of surname as gift can be given to anyone by any person . Or else you can make a sale deed but for sale deed you need to ahow money transaction
She can gift you the land after paying the stamp duty if the same is applicable on gift entries in your state. The difference of surname is immaterial. The levy of stamp duty will depend on the state in which the property is situated as different rates are applicable in different states.
